PUBLIC CONSULTATION FOR INTERIM REPORT
MARKET REVIEW OF THE DIGITAL ECONOMY ECOSYSTEM UNDER 
THE COMPETITION ACT 2010

MyCC has initiated a Market Review of the Digital Economy Ecosystem under the Competition Act 2010 [Act 712]. Spanning from July 2024 to December 2025, this review aims to assess and strengthen the competitive landscape of Malaysia's fast-growing digital economy.

Section 11(1) of the Act 712 empowers MyCC to review any market which to determine whether any feature or a combination of features of the market that may prevent, restrict, or distort competition. Recognising the digital economy's significant role in Malaysia's growth, MyCC is committed to enhancing the sector’s sustainability and effectiveness. The market review will examine key features and interactions within the digital marketplace that could affect competition. The scope of MyCC’s review will encompass:

I. Mobile operating and payment system;

II. E-commerce (Marketplace);

III. Digital advertising services;

IV. Online travel agencies (OTAs); and

V. Data privacy & protection (Discussed in all scope).

 

The MyCC is currently developing the interim report, and this public consultation aims to ensure a comprehensive finding by incorporating input from all relevant stakeholders. Submissions can be uploaded in the designated section or emailed directly to [email protected], starting from 4 March 2025 until 31 March 2025. All relevant stakeholders are strongly encouraged to participate and provide input during the review process. Your contributions will help MyCC to produce a comprehensive Market Review, which will be instrumental in shaping future policies and regulations to support a competitive digital environment across Malaysia, particularly for the sub-sectors.

Scope definition

Mobile operating and payment systems 

Mobile OS - Software platforms that manage core functions, interface with hardware, and enable application execution. 
Integrated payment system - Payment mechanisms embedded within mobile applications that use APIs, to enable seamless in-app transactions, for digital goods and services.

E-commerce (Marketplace)

Business-to-consumer (B2C) marketplace platforms that enable online transactions between merchants and buyers. These platforms serve as intermediaries, facilitating the sale of goods over the internet. Service-related platforms (such as transportation and food delivery) are excluded from this scope.

Digital advertising services

Digital advertising marketplaces and platforms that connect advertisers and publishers, enabling them to trade ad inventory displayed across search engines, social media, and other digital channels.

Online travel agencies (OTAs) 

Web and mobile-based platforms that allow consumers to book travel services, with focus being only on accommodation booking platforms.

Data privacy and protection

This study examines two key data-related areas:

  • Data privacy - The rights of internet users to control their personal information sharing and usage in the digital marketplace. 
  • Data protection - The mechanisms and practices companies use to prevent misuse or unauthorised access of personal and sensitive information they collect, store, and process. 

In understanding data privacy & protection across the four sub-sectors, key areas of data usage, transparency, data control and compliance will be studied.
